Overview
Garrett is a corporate and commercial litigator in the Delaware Court of Chancery and other Delaware courts. His practice includes a high concentration of stockholder derivative actions, cases arising from mergers and acquisitions, and governance disputes. Garrett also has extensive experience litigating breach of contract and fraud cases, alternative entity disputes, and books-and-records matters.
In addition to his Chancery practice, Garrett is frequently involved in appeals before the Delaware Supreme Court, where he began his legal career as a judicial clerk for then-Chief Justice Leo Strine. Garrett’s appellate experience has included not just appeals from cases he litigated in the Court of Chancery and the Delaware Superior Court, but also matters in which he was brought on at the appellate level. Outside the courtroom, Garrett regularly advises companies and their directors and officers concerning an array of Delaware law and governance matters.
Garrett’s advocacy has been recognized by a variety of leading publications, including Benchmark Litigation, which recently included him in its 2024 “40 & Under” list. Annually since 2021, The Legal 500 has recognized Garrett on its list of top M&A defense litigators, including most recently as one of nine “Next Generation Partners” nationwide and one of two in Delaware. Garrett has also been regularly recognized by Super Lawyers, and the Delaware Business Times has named Garrett to its “Top 40 Under 40” list of Delaware professionals.
Garrett’s scholarship concerning Delaware corporate law, including that published in The Business Lawyer, has been cited favorably by the Court of Chancery and academics alike. Garrett also maintains an active pro bono practice, which has included First Amendment litigation, family law matters, and serving as a court-appointed mediator in landlord-tenant cases.
