Pro Bono
Ross Aronstam & Moritz LLP recognizes the importance of providing representation to those unable to afford it. Among other things, Ross Aronstam & Moritz attorneys serve on the District of Delaware Federal Civil Panel, a panel appointed by the Court to provide pro bono representation in meritorious civil cases.
The firm's pro bono work includes defending the State of Delaware in litigation claiming that its assault weapons and large capacity magazine bans violate the Second Amendment. Following expedited proceedings, the District Court denied two motions seeking to preliminarily enjoin enforcement of the statutes. The plaintiffs appealed that decision to the United States Court of Appeals for the Third Circuit, where the firm successfully argued in defense of the statutes on behalf of the State of Delaware.
In connection with the Co-Counsel Project, the firm argued the appeal to the Delaware Supreme Court in Cannon v. State, No. 254, 2017 (Del. 2018), obtaining reversal of respondent's delinquency adjudication for criminally negligent homicide.
Ross Aronstam & Moritz has also made amicus curiae submissions to the Delaware Supreme Court. For example, in Matthews v. State, No. 24, 2023 (Del. 2024), the Delaware Supreme Court sua sponte appointed one of the firm's lawyers as amicus curiae to submit briefing and argue in support of the appellant's ineffective assistance of counsel argument, resulting in reversal of appellant's murder conviction. The firm also filed an amicus curiae in brief Brian E. Peierls and E. Jeffrey Peierls, Nos. 11/12/13, 2013. And Ross Aronstam & Moritz also filed an amicus curiae brief in the Delaware Supreme Court on behalf of the American Civil Liberties Union Foundation of Delaware urging affirmance in Delaware Valley Field Services v. Ramirez, No. 556,2012 (Del. 2013), a case raising the issue whether federal law bars undocumented immigrant employees who are injured in the course of their employment from recovering workers' compensation benefits.
