Ross Aronstam prevails in advancement action by securing rare post-trial decision finding claim barred by unclean hands

Ross Aronstam & Moritz, together with Glavin PLLC, defeated a former officer’s advancement claim—proving at trial that it was barred by unclean hands. The Court of Chancery noted that notwithstanding “Delaware’s strong public policy in favor of advancement,” this was the “rare” case in which the defense succeeded, crediting the Ross Aronstam team’s “impressive” trial presentation.
