New Jersey v. Delaware, 552 U.S. 597 (2008)

Seitz Ross attorney C.J. Seitz, working with Kellogg, Huber, Hansen, Todd, Evans & Figel, P.L.L.C., represented the State of Delaware in an original action in the Supreme Court of the United States concerning the scope of Delaware's regulatory authority.

In 2007, Special Master Ralph I. Lancaster recommended to the United States Supreme Court that the State of Delaware be permitted to regulate projects that extend from the New Jersey shore into Delaware territory.  In its March 31, 2008 decision, the United States Supreme Court substantially upheld the Special Master’s recommendation and confirmed Delaware’s authority to regulate extraordinary projects built from the New Jersey shore that extend into Delaware waters in the Delaware River.  The decision confirmed Delaware's right to exercise regulatory authority over British Petroleum's proposed liquid natural gas terminal.
